Halala is Haram

The worst and one of the filthiest act prevailing in the muslim society today is the act of halala. There are some good for nothing, so called scholars who have made the planned halala a halal thing for muslims. They have even hired special people to perform halala with the females so that they can remarry their husbands.


In Pakistan, there is a madrasah where the madrasah administration has hired blind people especially for this purpose so that they may not fell into love with their wives for one night. We should rather call it prostitution in madrasah legalized by the madrasah administration. What else could be filthy then this.

If halala was this easy muslims would have made it a game to divorce their wives and take them back anytime they wanted. In the pre Islamic era, the arabs used to take their wives back after they divorced them like this.
This is shere nonsense and a horrible joke with islam. Islam has never promoted such filth and those who do this are equally cursed. Scholars are unanimously agreed that halala which has been invested by some good for nothing people is haram and a grave sin and it will be zina. And zina is among the greatest sins.

Imam Ahmad reported that `Abdullah bin Mas`ud said, "Allah's Messenger cursed the one who does Tahlil, the one in whose favor it is done, those who eat Riba (usury) and those who feed it (pay the usury).'' At-Tirmidhi and An-Nasa'i reported this Hadith and At-Tirmidhi said, "This Hadith is Hasan.'' He said, "This is what is acted upon according to people of knowledge among the Companions, among whom are `Umar, `Uthman and Ibn `Umar. It was also the saying of the scholars of Fiqh among the Tabi`in (second generation of Islam). And it has been reported from `Ali, Ibn Mas`ud and Ibn `Abbas''.

Thus, this act is virtually haram and has no place in islam and muslim society. Nor should this filthy act be attached with Quran or sunnah anyway.

In his Mustadrak, Al-Hakim reported that Nafi` said: "A man came to Ibn `Umar and asked him about a man who divorced his wife three times. Then, his brother married her to make Tahlil for his brother, without the brother knowing this fact. He then asked, "Is she allowed for the first (husband)'' He said, "No, unless it is a marriage that involves desire. We used to consider this an act of adultery during the time of Allah's Messenger .'' Al-Hakim said, "This Hadith has a Sahih chain although they (Al-Bukhari and Muslim) did not record it.''The wording of this Hadith indicates that the ruling came from the Prophet saww. Abu Bakr bin Abu Shaybah, Al-Jawzjani, Harb Al-Kirmani and Abu Bakr Al-Athram said that Qabisah bin Jabir said that `Umar said, "If the participants to Tahlil are brought to me, I will have them stoned.''

This indeed is an act of adultery where one or both the parties know that what they are doing and what for. Second thing, which people make for themselves easy, is that when they perform halala they do not spend time together like husband and wife. They think that a mere nikah and the divorce are all needed. This is wrong. Those who want to remarry their wives now should have thought at the time when they divorce their wives out of anger or out of ignorance. To do halala one must not arrange a planned marriage because in this way they put a stamp on their act of zina.

Prophet Muhammad s.a.w.w said about halala;

Abu Dawood (2076) narrated that the Prophet (peace and blessings of Allaah be upon him) said:

: (Ù„َعَÙ†َ اللَّÙ‡ُ الْÙ…ُØ­َÙ„ِّÙ„َ ÙˆَالْÙ…ُØ­َÙ„َّÙ„َ Ù„َÙ‡ُ)

“Allaah has cursed the muhallil and the muhallal lahu.” This was classed as saheeh by al-Albaani in Sunan Abi Dawood. who is muhallil.

The muhallil is the one who marries a woman and divorces her so that she can go back to her first husband, and the muhallal lahu is the first husband.

Ibn Majaah (1936) narrated from ‘Uqbah ibn ‘Aamir (may Allaah be pleased with him) that the Prophet (peace and blessings of Allaah be upon him) said:

Ø£َÙ„َا Ø£ُØ®ْبِرُÙƒُÙ…ْ بِالتَّÙŠْسِ الْÙ…ُسْتَعَارِ ؟ Ù‚َالُوا : بَÙ„َÙ‰ ، ÙŠَا رَسُولَ اللَّÙ‡ِ . Ù‚َالَ : Ù‡ُÙˆَ الْÙ…ُØ­َÙ„ِّÙ„ُ ، Ù„َعَÙ†َ اللَّÙ‡ُ الْÙ…ُØ­َÙ„ِّÙ„َ ، ÙˆَالْÙ…ُØ­َÙ„َّÙ„َ Ù„َÙ‡ُ

“Shall I not tell you of a borrowed billy-goat.” They said, Yes, O Messenger of Allaah. He said, “He is al-muhallil. May Allaah curse al-muhallil and al-muhallal lahu.” Classed as hasan by al-Albaani in Saheeh Sunan Ibn Maajah.

From these ahadith, we see that the act of halala was a jahiliya act and this jahiliya act was prohibited in islam and today some people act same like the people of jahiliya.

Divorce is the most disliked legal and permissible act because once a female and male separate, there is no way for them to join again except any accidental event occurs.
